Legal, original documents lost by agency

What actions are appropriate to take towards a Passport Agency, having failed to return my original documents after requesting them by many and various occasions? Agency states that they have conducted a thorough search, and do not posess them.

Dear Inquirer:

You may wish to pursue either a Federal Tort Claim Action against the Passport agency, or file an action for Mandamus relief in the US District Court. The first may be appropriate to seek damages against the agency; the latter would be usesful to compel the agancy to search and locate the missing documentation. It may be that they have not searched as diligently as they claim.
