To properly answer the question, we need to know your current immigration status and if you had any prior record. Regardless, a withhold of adjudication will not prevent the Department of Homeland Security from treating the case result as a conviction. You may wish to speak to an attorney about your situation before you enter a plea of any sort.

A withhold is normally a conviction for Immigration purposes. An attorney needs to have more specific facts to determine if you will be removed and if you have waivers (defenses).

How did you come to the country? Did you enter with a visa or without inspection?

Which country are you from?

When did you arrive?

How old were you?

When was the crime committed? (date)

Did you receive any other sentencing beside the withhold? Did you serve jail time and if so how much?

Have you been previously deported or ordered remove?

Do you have additional crimes in your past?

Please contact my office for a consultation.
