Marriage to an alien who overstayed a visitor vis

Hello, I have been with my fiance for 5 years. He has been in the US for the past 3 years and we want to know what the process is to get married. Since he overstayed, will he have to leave the country? Also what documents and fees are necessary?

His overstay could be quite serious and it is important how long he overstayed. After filing the necessary adjustment of status papers he might be required to leave the country for a period. Also, you may need to show exceptional circumstances as to why he should be able to live in the US, and why you cannot go and live with him in his country.

You should address the immigration problem before you get married unless you're willing to live apart if he has to leave for a long time. We handle immigration matters like this.
