Legal Question in Immigration Law in Florida

Marriage and Immigration

I have a friend in Florida who has a work visa, has been married to a us citizen for two years and had a child from this marriage. The couple has been separated (not leagally separated) for seven months and divorce papers have not been filed by either party. He would like to seek permanent residence, but does not know how to go about applying for a green card. He is concerned that his wife will not attend his meeting with immigration and will be deported. What rights does he have since he is still technically married and has a son that was born in the US?

Re: Marriage and Immigration

Unless you can prove that you were abused by your US citizen spouse, you need their willingness to support you.
