It will depend upon what paperwork his mother filed, when it was filed, and if he was included in any of the paperwork. You will need to hire an attorney to sort through this for you. I suggest that you gather all that you can regarding both his entry and any and all immigration papers filed by his mother or father or directly on his behalf in the past first.
