Legal Question in Immigration Law in Florida

A person from Honduras entered the US illegally but obtained TPS before April, 2001. He is currently working and needs to obtain a certificate of labor. The company that he works for will sponsor him. The question is, can he obtain residency once the certificate of labor is approved?

This is an issue that is being argued over at the appeals court level, as to whether TPS status can overcome the EWI bar. I suggest you consult with an experienced immigration attorney who is familiar with this particular issue. The law may also be clarified by the time your friend wants to adjust.
