Dear Inquirer:
The answer depends on what type of conviction we are talking about. The US Immigration Law prohibits approval of a petition filed by a person convicted of certain domestic violence, rape and other sex crimes for a spouse. This provision may be waived, however, in the discretion of the USCIS.
