problem with my attorney

i am using an immigration attorney because my brother is about to be deported. when we first hired him he said it would be 12,000$ he said he usually takes it all at once. But he would make an exception for us. After we paid him the six thou. four months later he calls and says the hearing is in a week and he is expecting us to pay him the rest by then. But the trial is not for another year or so because he is asking the court to move the trial to a different city. So what do i do. he says if i don't pay him in a month he will no longer represent us. and if we want him to go to the hearing, we have to pay him more money. how do i get some of the six thou. that he has from us. is there anything we can do??

Did you sign a written retainer agreement? The agreement should spell out clearly when fees are to be paid. Any ambiguity regarding the terms should be construed in your favor not the attorneys'. Did you consult with a number of attorneys prior to retaining counsel? Is this a case before the Immigration Court or before the Federal Courts? If it's in front of the Immigration Court itself that seems to be a pretty high fee.
