Provide H1B with a small business

I am starting a small business and I would like to know if I can sponsor someone and apply for a H1-B - Thanks

If we can show that your business needs a specialty worker (one with a bachelor's degree), once we also discuss the type of business you have, yes you may be able to petition. Right now there are still H-1B visas available, so I would quickly discuss a possible petition with an immigration attorney.

Dear Inquirer:

As long as your business can justify its need for a professional employee, i.e. you have a job opening requiring a bachelor's degree or higher, then you may seek H-1B status for that worker. Note that the annual quota of H-1B visas for Fiscal Year 2010 open on April 1, 2009 and approximately 50,000 of an available 60,000 H-1B visas have altready been used. Therefore, time would be of the essence if your company would like to hire the worker beginning October 1, 2009.
