Refugee status and Work Visa

Hi,

I applied for an asylum about 2 years ago, but unfortunately my case was denied. I appealed, and there are a few months left before the emigration court will make next decision about me and my case. No doubt that more likely I will get a deportation.

I have a Bachelors of Engineering and I am wondering if I can apply for a Work Visa with my current refugee status. At this moment I am searching for a company that will hire me.

Please help me with my situation and if you can help I will certainly hire you.

Mykhaylo, unfortunately, unless you can prove that the delay in the processing of your asylum claim was caused by the government, your presence in the U.S. is unlawful and, therefore, you cannot change/adjust status to any other based on employment. You can read a case called Matter of L-K- where a Ukrainian woman applied for asylum and later on won a green card. The theory of unlawful presence in these cases was established by this case. The current law allows to adjust status in this situations if you have LIFE Act protection or are an immediate relative of a U.S. citizen. Udachi Vam!
