Does a spouse have any obligation to report their partner's visa overstay and/or sponsor the partner for legal residency?

A spouse is not obligated to report his/her partner's overstay. However, if the spouse petitions for the other spouse to receive a greencard, the petitioning spouse must sponsor the receiving spouse.
