Legal Question in Immigration Law in Florida

Transsexual Marriage and Imigration

I met my boyfriend 4 years ago in Florida.

This year he and I decided that we want to get married, so we have got engaged.

I am a Transsexual and my country does not at this moment in time allow us to change our birth certificates like they do in Florida and 47 other states.

The govenment is looking at allowing change at the moment, but still have not worked out how or when this will happen. They do how ever pay for the surgery and reconise it as a medical condition.

As the USA allow Transsexuals to change their birth certificates and I assume marry, will they reconise this when it comes to immigration. If I have to produce my birth certificate it will show the gender I was born by and not my present gender. How will this effect me.

I don't want to find that after we have got married I can not move to Florida to live with him, as this will seriously effect our relationship and future.

Re: Transsexual Marriage and Imigration

I have actually come across this typ eof case before, but the alien's country reissued a birth certificate upon the operation. I will have to research this, but my guess is that you would be best off by getting a letter from a doctor attesting to your current gender. Email me if you would like to discuss this further. Good luck!
