Legal Question in Immigration Law in Florida

I am u.s.a citizen. I was born in the u.s.a. I am currently living with my boyfriend in Florida.My boyfriend is here on a tourist visa. I have a criminal record of theft which was a felony and my judication was withheld on the theft charge. I have 2 misdemnor crimes of prositution. All of these crimes were in 1989 and I have not had anything other crimes. If we get married will they check my record even though we are both living in the u.s.a.? I do not want my boyfriend to find out what I was arrested for.

Unfortunately it's going to be hard to keep your past convictions from your boyfriend if he is petitioning for you. U.S. Immigration will have a record of these convictions. Withheld adjudication is a conviction for immigration purposes also. I would need to see your full record of conviction before I can advise you of what waivers would be applicable to you.
