Legal Question in Immigration Law in Florida

withdraw I-485

I am from Mexico, I married my wife in good faith(love) in 2005. Because delusions and she being emotionally unstable she abandon me, on Sept 2005 even when we are still in contact we haven�t been able to come back together. We have been going to marriage counseling and things are still not working. We got the first appointment on Dec but since we were not living together my attorney recommended to withdraw the case so we did. And unfortunaly I just receive a letter from USCIS in the mail at the end of January. Mentioning that they received the withdraw and they are not initiating removal proceedings against me at this time. The decision resulting in the withdrawal of Form I-485 leaves you without lawful immigration status.

She has been trying to make my life hard and miserable, she has been harassing me over the phone It�s harder to get home from work because she is outside waiting for me looking for a fight. I had to call the police once. My questions are Is it possible to do this even when I didn�t go to the first appoinment? How risky is to do this? is it possible to re-schedule my appointment an explain to the officer my situation. How risky this could be? Are there other course of action that I can take?
