Legal Question in Insurance Law in Florida
At-fault driver has not admitted fault to insurance company
A driver hit the back of my car. The
damage is under $400. I have already
filed a claim with her insurance
company but it has been 2 weeks now
and they are still waiting for a
statement from her, even after multiple
contacts to her household. The
insurance company will not accept
liability until she gives her statement.
I'm worried that she will not contact her
insurance company and I don't want to
file a claim with my insurance and have
to pay a deductible. The police were
called but they only filed an ''exchange
of information'' because the accident
happened on private property (parking
lot). However, the police officer did say
that the driver listed under ''vehicle 1'',
on this form, is usually viewed to be at
fault which is where her vehicle is
listed. My question is, how long should
I wait for her to contact her insurance
company before taking further legal
actions? And what legal actions can I
take?
