Legal Question in Insurance Law in Florida
Auto damaged
I have a new 2007 $40,000 auto with only 1200 miles on it and was hit while parked in a lot at Dr. office. The party that hit it has full insurance but they are only offering to repair. I want another new car that has not been repaired. Is this feasable? I don't want to pay for 6 years on a vehicle that has had over $5000.00 worth of repairs as a carfax report will now show. Should I get a lawyer or is it a waste of time. All I want is another new vehicle that has not been repaired. They can repair this one and sell it. Any help?

They are not required to buy you a new car. However, you are entitled to the cost of repair, the value of lost use while it is repaired, and the diminution in the value of the car because it was so severely damaged.
