Auto Insurance Claims

was involved in a ''hit and run'' - person who hit us was driving mom's rental car - was an unauthorized driver - mom did not carry him on her insurance policy and now her insurance company says they are not liable...need to know my options - keep going through her insurance, take her and son to small claims or try to go through rental car company insurance? Please give some direction as to where to go...

Generally speaking, there is no coverage for an unauthorized driver. Whether someone is unauthorized or not, however. Was the car reported as stolen? If not, it may not have been unauthorized. Was the owner negligent for providing access to the keys ? How did he get the keys? Had he taken the car before and, if so, what precautions were taken to prevent this in the future.
