auto insurance company wont pay claim

I was in an auto accident on Jan. 20. No personal injury. I contacted the insurance company of the man who hit me, to pay for repairs. I had to file a complaint with the insurance commissioner. After initial contact, no one contacted me. Finally on March 13, the sent out an adjuster. I spoke to a customer rep, from the insurance co. on Friday March 31 to find out what was going on, they informed me they where still waiting to hear from the adjuster. However, once I informed them I spoke to the adjuster, prior to calling them, they said a request for payment had been submitted, but could not tell me when I could expect a payment. I have left a dozen message since Friday and no one will call me back or give me any answers. Since the day of the accident I have only spoke to the rep. handling the case once. He wont call me.

Is there anything I can do? I am afraid if I contact a lawyer, I will lose any money the insurance company will give me, to lawyer fees. Since there is no Bodily Injury, I know it wont be a big settlement. Insurance Commisioner offered little help.

Can this company take as long as they want to settle this?

yes, if the amount is less than $5,000 you can sue the other driver in small claims court.
