Legal Question in Insurance Law in Florida

Car Accident Insurance claim

I had a car accident on Sept.19,2003 ( I was at fault) My car was immeadiately towed to a Body Shop and I contacted my Insurance Company that Monday Morning. It has been a month and a half and I can never get throught to the person in charge of my claim. I have left several messages and they are never anwsered. The Car has been ready for the past 2 to 3 weeks and I have not been able to pick it up because I am still waiting for the insurance companies check. The last time I spoke to my claim representative she told me she was going to fax me a paper needing to be filled out by me and faxed back to her that same day before payment could be disbursed she also told me that the same paper would be sent through regular mail also needing to filled out and notarized and sent back A.S.A.P I have yet to receive either. Since then I have left her several messages and have gotten no response. What should I do?

Re: Car Accident Insurance claim

You must be persistant. Call again and ask for the adjusters supervisor. There is no excuse for the delay. Document your requests by email, letter or fax urging action. Pick up the car if you can by putting on your charge card.
