Legal Question in Insurance Law in Florida
Car Insurance wasn't changed as appropriate?
Yesterday I was involved in a 4 vehicle accident in which I was the rear vehicle. I was the last vehicle to hit and as such, may be blamed for the accident. Regardless, I called my insurance company today and they told me that I don't have full coverage on my car. I gave my statement to them then contacted my agent who said that all she did was transfer coverage from my last vehicle (had full coverage). The only paperwork I have on it only states that the coverage was transferred and not what the coverage for this vehicle is. However all the paperwork from my old vehicle verifys that it had full coverage. She said that she would speak to the insurance company and call me back. She just called back saying that she had set up the coverage incorrectly. What do I do? Obviously the insurance company is not going to foot the bill because the agent didn't know what she's doing. If the agency refuses to cover it, is there any legal action I can take?

Re: Car Insurance wasn't changed as appropriate?
You may pursue a claim for an Error or Omission as Agents do carry this coverage in an event as you have discussed. It would be interesting to see what forms you had signed detaling coverage. Were the premiums similiar or were you getting a cost savings?
