Legal Question in Insurance Law in Florida
Can I be charged for a car accidents expenses
My husband was involved in a car acciednt last year
where he was charged with a non moving violation. He was not driving but only trying to start a stalled truck for a sibling. a car came along excedening the speed limit by 25 mph and slamed into the side of the truck and the woman was treated for a broken leg and totaled her car. They are now trying to sue us for the payoff on the car, is that possible??

Anyone can sue you for anything it simply involves filing a few documents and paying a filing fee. It is quite another matter to sue someone successfully. To do so requires proof of legal liability and recoverable damages. If you are sued, you should first notify your insurance company (who may be obligated to hire a lawyer to defend you) and then consult with a lawyer.

If it was nighttime and the car sat in the middle of the road without lights there could be liability. It is impossible to answer your question on skimpy facts. Notify your own insurance company and consult an attorney.
