Damages in an apartment fire
There was a fire in my friends apartment caused when her daughter was visiting and fixing some fried potatoes. Even though the landlord held insurance on the building, the insurance company is stating that my friend owes $44,000 for the damages

It sounds like you are talking about "subrogation". The insurance company is seeking reimbursement from the person(s) responsible for the fire. If your friend caused the fire then they will probably have to pay something.
Just because there is insurance doesn't mean that the responsible party is exempt from liability.
