Legal Question in Insurance Law in Florida

Dirt bike accident

Florida,Osceola county My son age 16 has a 100 cc dirt bike, paid off and not covered by vehicle insurance. An incident occurred in a residential neighborhood in 10-02, where an 18 year old asked permission from my son to sit on the bike, which he was given. The individual then started up the bike and took off, crashing it into a garage door.I called the highway patrol and an officer wrote out a crash report and cited the 18 year old 2 tickets,Careless driving and No motorcycle endorsement. My son was issued no citations. The individual paid both fines.I received an estimate for $700 to repair the motorcycle and the homeowner had his insurance pay $1190 to repair the garage door. His insurance company has contacted me to pay for the garage door repair.I contacted the 18 year old about working out payment from him.Since then,I have had to contact the local police twice regarding this individual threatening my son physically. Both times they decided not to file reports, saying that it was just scare tactics. My question is this;Should I pursue this in small claims court or is it possible that his auto insurance should cover my expenses, and should I start paying monthly for the garage door

Re: Dirt bike accident

Since your son owned the bike he is responsible for the actions of the driver operating with permission. If it was operated without permission, your son is not responsible. If the insurance carrier sues your son for reimbursement you can sue the driver. Good luck.
