Legal Question in Insurance Law in Florida
Disability denial - should I pursue it?
Tonight I saw the report on 60 Minutes about Unum Provident and
their policy of denying or closing claims. I am a person that recently
filed a claim with Unum and was denied. I am a person with AIDS that
was on government disability but went through vocational
rehabilitation and went back to work in 1997/98. Last November, I
had some severe emotional problems, so severe that I couldn't go to
work. When my claim was denied, I scrambled to find a way to cope
and got my doctor to prescribe an antidepressant, which helped, but
after 3 more months I left the company and moved back home to
Kansas City, where I have now re-filed for Social Security disability.
At the time, my therapist didn't think I should have gone back to
work so soon, but understood that I had to support myself.
I appealed their decision, but of course it was not changed. In light of
the new information about Unum on 60 Minutes, should I seek legal
remedy for my claim?
Any thoughts/comments are welcome.

I saw the story about UNUM on 60 Minutes. To answer your question, I would need to review a copy of your Policy, your therapy records (not every page; the important pages, information regarding your emotional problems and get dates
regarding your work, and your disbility paperwork (both times; the applications, etc. If you overnight these copies to me, I will review your case.

I worked with 60 Minutes and Dateline which did a similar story last month. You should pursue your rights for policy benefits kbowing that UnumProvident is conducting a dirty war against its claimants, including a number of AIDS victims. Your attending physicians support for your claim is crucial to success. If you need a referral to an experienced erisa disability attorney in your area, you may contact me at no charge.
