Legal Question in Insurance Law in Florida

I have a doctor that I have been going to for quite a while and I realized in April of 2009 that I had overpaid them by about 2000.00 and am trying to get the money from them. I have received about 300.00 from them but can't get any more. I can only email them. There is no one that will talk to me and I haven't heard anything for 5 months. They have kept my insurance money and my discounts. What can I do? I have talked to my insurance company and they said that my doctor was doing this wrong. I should have never paid in full up front. HELP ME PLEASE!!

If they won't return the funds, then you will need to file a small claims action.

Sometimes your insurance reimburses you directly, but if it's the doctor's office that owes you I would send them a letter telling them that if they don't pay in full by a certain date, you will take them to small claims court. It seems odd that there is no one in the billing office that will speak with you. Regards,
