Legal Question in Insurance Law in Florida
False information in regards to work benefits being cancelled
I married 12/18/07 and according to my employer's benefits handbook, I have 31 days to call and cancel benefits if I am going to be covered under my husband's policy. I called to cancel 1/16/08. The representative at the time assured me that I would have coverage until 01/31/08. I have since been notified that my coverage was cancelled effective 12/18/07 and that I will not be reimbursed for any of the monies already deducted for these benefits. Due to incorrect information provided by that rep, could I not obtain a copy of the conversation and possibly pursue legal action? I have had several Dr.'s appts. from 12/18/07 to current which I will be receiving bills for since the insurance is now denying those claims.

Did you get any of this in writing? Were you covered ubder your husband's policy? You need to read the cancelation procedure very carefully and it will spell out your rights. It would stun me that a call on 1-16 would retroactively cancel coverage -- particularly if a premium was paid.
