Legal Question in Insurance Law in Florida
Health Insurance - Through Employer
I am having a hard time getting my employer (HR department) to get the ball rolling with my Health Insurance. I have been employed with the company about 5 years starting out as full time with health insurance. I then went to a part time status and dropped my Insurance. I have been back to working a minimum of 32 hours a week for at least 3 months now. I realized that I should be eligible for Insurance due to being full time again. I went to my HR department and they had no information. They gave me the telephone information for Paychex. when I called Paychex to find out how to get the insurance packets they said my full time status had not been updated in the system. I have followed up with the HR Dept a few times - they say it is done but when I call Paychex they say it has not been done... Although I don't feel I should have to chase the information down myself it is important to me so I have been trying to take care of it for the last 2 weeks now. Today when I spoke with them they said I would have to wait until November. I have read through all of the FL Statutes but can not find the exact information I am looking for. I am wondering if they are in violation of any kind by not even informing me that I was eligible for the cov

Re: Health Insurance - Through Employer
Your post does not say why you must wait until November. If your employment agreement and everyone else's says you get insurance when you work full time for 3 months, then a failure to provide it is a breach of the contract. So far, though, it does not appear that you have any damage (no doctor's bills). If you had a bad accident and needed health insurance coverage you would probably have a good claim, but if you go for a general check up it is not worth suing over a $50 doctor's bill when it might cost you your job.
