Legal Question in Insurance Law in Florida
Is it illegal for a homeowner to file an insurance claim for home damage, has the repair work done, and when the check arrives they cash the check and not pay the contractor who the insurance approved the amount to pay them? Is it insurance fraud or a lien law?

If the homeowner does not pay the contractor for the work done the contractor has the right to file a lien against the property regardless of whether insurance monies are involved. If you are the contractor and wish to discuss your rights in further detail you may contact me at (305) 777-0411.

If you don't pay the contractor, he will probably put a lien on your house. You will have to pay him to get it removed or file a notice to contest the lien and possibly face a lawsuit. Regards,
