Why is an insurance co. not liable to pay for full damages even when their drunk
I was hit from behind by an under-age drunk driver while sitting at a red light. The car was totaled.It was still being paid on and the drivers insurance will not cover the full cost of the car. Now I am being threatened to be taken to court by the dealer for the remaining cost of a car that I no longer have. The driver was immediatly cited at the scene and taken to jail. Is there any way to get this money out of the driver or a way to avoid this cost at all?

Liability and damages are different concepts. You should sue for all damages if you are not happy with the offer.
