Insurnace limits

Does having a lawyer represent you enable a larger settlement from an insurnace company (or is the insurance company only liable for the maximum amount that was insured?) My daughter was a passenger in a car that was struck by a DUI limo driver. The driver has minimal insurnace coverage, and the owner of the limo company cannot be found. Does having a lawyer represent us enable a larger settlement with our own insurnace company or are we better off getting it ourselves? Is the insurnace company only able to pay us the amt that was insured?

Generally speaking having a lawyer means a better settlement but if the policy on the driver is only $10,000 that is the most you can get with or without a lawyer.Your own insurance coverage again depends on the size of your uninsured motorist coverage. Do you have stacked coverage on two or more cars? A lawyer might help you find the limo owner. If the total coverage is severely limited you may want to have the atty work on an hourly fee or a flat fee for advice rather than a percentage.
