Legal Question in Insurance Law in Florida

Lawsuit atemming from an rental auto accident 9 years ago

On April 30,1994 I had an accident near Charlottesville, VA in a rental car of a reputable company. I had purchased additional damage insurance from the company at the time of renting. The car was totalled with a replacement costapprox $11000. The accident did NOT involve any other automobile or person, and was due to distraction caused by an animal crossing the highway at 3AM. The rental company tried to collect for damage through a collection agency in 1994 but dropped the proceedings for unknown reasons. Now they want to sue since they could not collect through insurance. I did not have comprehensive insurance on personal vehicle at that time. Please advise as to my options and statute of limitations.

This is a question of Virginia law if you rented car in that state. I don't think any state has a statute of limitations that allows suit after 9 years. You may want to meet with an attorney regarding violation of the Fair Collection Practices Act.
