Am I liable for trees falling on renters' vehicle?
Tree limbs fell on renters' car in March 2005 causing scratches. My homeowners' insurance rep said if tenant wanted to make a claim, he would do so under the comprehensive part of his auto policy since it is considered an ''act of God''. Trying to be nice after seeing it was only scratches and to save my tenants having to make an auto insurance claim, I told them to get me several estimates from good detailers and I would pay for the work. Two months later, they finally send me an estimate from a collision shop for $500. I refused their demand and offered them $200 for a detailer and informed them if they rejected my offer, they could make a claim against their auto policy. The male tenant said I have an obligation to pay their damages in full when they send me a certified letter requesting full payment in 30 days. He further stated that if I do not pay it within 30 days, they are entitled to deduct the $500 from next month's rent. Is this true?
