Legal Question in Insurance Law in Florida

life insurance policy

My grandmother passed away and had a life insurance policy which she left for her surviving daughters to share equal as beneficiaries. The oldest daughter, my aunt, absconded with the policy and told the 2nd oldest daughter, my aunt, the policy was for $2,000.00, and each daughter would get 500. My mom recalls seeing the policy, policy being of more value (10k) and cannot recall the name of the company. The sister who took the policy is not sharing any information, will not let anyone see the policy and has a long history of being dishonest. How do we find out the insurance company name and information pertaining to the policy and verify my mom as 1/4 beneficiary and the amount of the policy. Thank you.

Re: life insurance policy

These are always difficult. The insurance company would not issue a check (or should not) to people not named as beneficiaries. Without knowing the insurance company or the policy number you can't check. If an estate has been opened, your sister can be subpoened and forced to produce the policy and information about it, since it is possible that the policy named the estate as a beneficiary. If there is no estate, you can retain a lawyer and open one to begin the process.
