Legal Question in Insurance Law in Florida

I live in FL. My wife was in an accident and the other party had declined bodily injury. We have $10k in PIP which we have about exhuasted. I am aware our uninsured bodily injury now will start paying and the max is $100k. Are we able to ask for a settlement on that coverage to ensure if anything comes up in the future that is related we would have monies to pay for that?

I'm sorry to hear about your wife's accident. The uninsured motorist insurer stands in the shoes of the insurance company for the at-fault driver. That means that all of the damages that your wife has, both in the past and in the future, go into the mix of things to be considered. The uninsured motorist insurer will make a single settlement offer based on its estimated value of the claim, including past and future medical bills, and pain and suffering.

The UM coverage wont just start paying for medical bills after the PIP . As Mr. Meyer describes it is resolved in a lump sum fashion with one payment being made for all damages. You really need to have an attorney to assist you in this process. Don't attempt to do this on your own.
