Legal Question in Insurance Law in Florida

loss of wage recovery

I am under a medical doctors note to not return to work until December 1st, my family is suffering financially.

If I go find a job and work while under this note am i committing a crime? I am the victim in a car crash, and the medical doctor has diagnosed a pinched nerve etc. Injections begin soon to manage the pain.

The insurance company has compensated me for 60% of loss of wage for the month however the amount falls short of our budget.

My question is why is it a crime to support my family. When the insurance company is only reimbursing me for 60%

of my loss of wage. I need the other 40%, why can I not

simply go out and earn it. The at fault carrier says it will be included in the settlement, I dont have a crystal ball. I am certainly willing to go and work in pain and die if i have to so my 3 little ones have a christmas.

Would it not be duress under the law to not pay somebody until they agree to a settlement?

to be fraud or not to be
