Can you go over the policy limit ?
My attorney, settled my case without my written consent, He told me that the 100k policy limit was all I was entitled to get, when I asked him about going to trial. Is this true that being my injuries are permanent , and after all the bills are paid I will not be able to get surgery on what is left over. I'm curious isn't there some sort of pain and suffering ? My wife and I were newly weds ready to plan a family before this accident. It was an uninsured motorist case I was a passenger, if I am unable to go over the policy limit from the insurance company can I persue the driver of the car I was in. Thank you

I would have to know some additional facts. Which vehicle was uninsured? Which vehicle waws responsible for the accident? Did you have your own uninsured policy? Generally, when you settle with an insurance company they are subrogated to your rights to try to collect the amount paid. This would prevent you from trying to collect.
