Legal Question in Insurance Law in Florida
I recently got into an accident where someone closed a gate on my car while I was entering a lot. I notified my insurance company and now they're trying to find various ways to say it was my fault. They keep changing their reason as to why it is my fault and when I ask them to send me a written statement of their investigation results, they refuse. I had a witness who saw the whole thing and now they're trying to twist his words to suit their purposes. Is there any way I can request a written copy of their "investigation" results so I can refute it without the insurance company changing their reason after each time I prove them wrong?

Fault does not matter if you are making a claim against your insurance. If you are claiming against the gate operator's insurance, then fault will matter. You are not entitled to their investigation results to help you attack their conclusion, again related to the third party. You can file suit if you are not happy with the response. You may be better off allowing your insurance company deal with the matter. Let them go after the third party for subrogation. If you are discussing your insurance company, then I suggest you hire an attorney.
