Legal Question in Insurance Law in Florida

Rental car unauthorized driver, covered by own insurance?

The rental car company charges $5.00 per day for an additional driver. If I do not pay the $5.00, but the additional driver has an accident, and she is fully covered by her own car insurance, will the accident charges be covered?

Re: Rental car unauthorized driver, covered by own insurance?

As long as her own policy covers her no matter which vehicle she is in (all policies in PA do), then she is covered. However, keep in mind, the coverage is for liability, meaning that if the accident is her fault, her company will cover her. However, if for example there is a hit-and-run accident which causes damage to the rental car, you need to check if her policy covers. If it does, it will cover after the deductible amount in her policy, and probably only up to the value of her car. You will need to check this with her company. You may know that some credit cards cover damage to a rental vehicle, if you use that card to rent the vehicle. You'll need to check with the credit card company for details. Hope the above helps. Good luck.
