She ruined my rare scooter

I'm not sure what I should do. I was hit by a car that ran a red light. She was talking on her cell and didn't notice the light. She totally admitted it and I have 3 witnesses that gave the police the report.

I went to the emergency room later that night and to get checked out and I was sore for a few weeks. I didnt get hurt that bad. I jumped off in time, but my scooter wasn't so lucky, it is a 1979 lambretta jet 200. If you look on the internet you can see it would be worth anywere from 4000 and up.

Her insurance want's to give me $3000 or $2500 and keep the bike. I can't replace the bike for that and if I did find one for that, it would be out of state or country and that could cost up to $800 to ship.

Her insurance said they would pay for all my medical. I have yet to see a dime.

Is it worth the time and money to get a lawyer to fight them? And is it posible to go after her if her insurance dosn't give me what I feel is fair?

This is a no fault state and I don't know exacly what that means.

I would definitely urge you to seek the help of a lawyer and not let the ins co get away with their low ball tactics. You are entitled to the full replacement value and the value of your injuries. Seek a young lawyer with compassion for your problem that might be willing to cut you a break on a fast settlement by waiving the fee on the property damage and charging only on the injury claim. The Company will not want to spend the money to litigate this case and should cave in quickly.
