Legal Question in Insurance Law in Florida
My sisters husband died. They had mortgage insurance, but she found out it was only single life not dual. Their loan does not state a name of the insured, but indicates "single life (Borrower). My sister's name is on the first line and her husbands is right below hers and they are listed under Borrower(s). The loan company states it is only for her since her name is on the first line. Is this true, or can she fight this.

It is possible that both your sister and her husband would be deemed to be insured under the policy. Your sister really needs to have an attorney who is skilled in this field look at the insurance policy. She she look for an attorney who has handled claims against insurance companies. In particular, she should look for an attorney who's board certified in civil trial law, as are the attorneys in our office. This indicates a certain expertise in this field of law.
We offer a free initial consultation and would be happy to speak to your sister about the situation.
It really depends upon the mortgage insurance policy (not just the loan). Review the policy carefully and have your sister contact an attorney handling civil litigation & real estate in Pinellas County for a free consultation. Please do not hesitate to contact me if I can be of additional assistance. Regards,
