Legal Question in Insurance Law in Florida

I am a victim and feel like the felon.

A man I was briefly dating took my car keys one eve. after I went to bed and stole my car, went to a bar, got drunk and picked up a woman and was heading down to the beach to have sex. He totaled my car, the woman was topless at the time with no seat belt. He left the scene of the accident, the Cocoa Beach police detained him walking down the road then let him go because he claimed it wasnt him but they didnt take him to the woman (she didn't know his name) to identify. He got to my house as the Brevard county Police showed up and I told them he stole my car. He told the police that I gave him the keys and he lived with me. I knew he had a suspended license and would never let him drive my car and he never lived with me. The insurance company I just switched to less than 30 days ago are considering not to pay the claim because he claimed he lived with me and I gave him the keys. I filled official charges with Brevard County and Cocoa beach stating he stole my car. Now the woman in the vehicle has obtained a lawyer. What are my rights? Can the insurance company not pay for my vehicle (2005 nissian altima lease) and if the car was stolen could this woman sue me? I am the victim here and I feel like the felon! Please help!

You will need representation. Both the woman and the man will claim you gave him permission to drive and your insurance carrier will probably take the position you didn't. They will probably disclaim any coverage and leave it to you to fight.

If you left your car keys out for him to take you will have a claim of negligence made against you. Your carrier should pay you for the car damage. Good luck.
