Academic Exam Copyright

If I create an academic exam based on fact, can federal copyright protection be obtained for the exam and answers?

I ask since my understanding is that tests cannot be protected since they are based on facts.

The "based on fact" has nothing to do with getting a copyright.

If you author an exam, you can get a copyright on the exam. that does not, of course, mean that no one would ever be able to ask one of "your" questions on an exam.
