Legal Question in Intellectual Property in Florida

I have a copyright for a Hippo Pillow from year 2000. It is a pillow with a Hippo head that velcros together which makes it stand on the (4) points of the pillow. We have seen similiar pillows called Pillow Pets that look very close (other animal heads) and operate the same way (close with velcro) and are on the market today.

Has my copyright been infringed upon?

Thanks

Chris

As a Franchise Attorney I think you are operating on a mistaken assumption. Copyright protects published works as well as maps, dramatic works, paintings, photographs, sound recordings, motion pictures, and computer programs. It doesn't protect your Hippo Pillow. For that, you would need a design patent. Consult with a good business or franchise attorney in your area for specific advice.
