Legal Question in Intellectual Property in Florida
Implied Copyright on my menu
I own a restaurant and had my restaurant menu stolen from me by my ex-spouse who is now opening up a restaurant near me with the same menu. Do I have legal recourse and standing?

Re: Implied Copyright on my menu
If your menu contains original and distinctive elements you would have a case in copyright infringement as well as other business law theories.

If you created the menu, then yes. If you both created the menue, then probably not. If you created the menu, then you need to seek a court order stopping the other ASAP.
