Legal Question in Investment Law in Florida

Obtaining Old Trust Documents By Trustee

I am co trustee of my grandmother's trust. When she passed away in June, '03 (she lived in Florida) I discovered that monthly statements for her trust were missing for approximately the prior six months, also missing were bank statements for the same time period.I asked our broker for copies of the missing statements and was told that they had them but could not give them to me ( they said basically it was illegal). The bank would get me the missing statements but wanted to charge a lot of money to do so. Am I entitled to get/see those back statements? I am concerned that people were taking money from my grandmother, taking advantage of her. All her other papers and statements were in order except the ones mentioned. My cousin and co trustee has no objections to getting these statements. Please help. How can I get these missing papers? Thanks

Re: Obtaining Old Trust Documents By Trustee

Your rights, duties, and obligations depend on the specific terms of the trust that you grandmother set up. However, as trustee, you should at least be receiving bank/brokerage statements. Were you receiving timely statements before this time? Do you have a copy of the trust document?

What type of broker are you trying to get records from? As trustee you should be entitled to a full accounting of the trust.
