401K employer contributions

When one is laid off [lack of work} can the employer take back 401K contributions it gave into it's employee? We asked to roll-over into another type of IRA, expecting what money we had in the 401K $1900. Instead, the company returned to us, $16oo. the money we put in, but they kept the $300. they put into it. Can they do this?

If you were not vested in the contributions your employer made, then they would not be included in any rollover/distribution.
