Legal Question in Employment Law in Florida
On May 7 2009, I was in a motorcycle crash that nearly took my life. I was placed on short term disability through my employer, then moved to long term disability in July 2009. I have since been released from disability, not necessarily by my primary care MD, but by changing my life and living conditions, and basically removing myself from therapy. I was intending on returning to my previous career, even offering to serve as an unpaid volunteer in order to prove that I was capable of returning on a full time basis as I still have some doubts as to my endurance and range capabilities.
I have since learned that my previous position has been filled, and there are no opportunities available to me in the local area with previous employer. I have contacted regional vice president regarding other possibilities and have heard nothing back for one week.
What are my options legally regarding either return to employment with the previous employer or being financially supported in retraining for different career pathways. I am a certified licensed orthotist, and there are very few options available to me in that particular field in the local area.
Thank you for your time.

You probably want to go through all of these details with an employment attorney. How man employees does your employer have? Did they offer you PTO or FMLA time to run along with your disability payments? Does the disability policy pay if you are unable to work in your own profession or any profession? There are quite a few issues that need to be addressed. Feel free to call my office if you wish to discuss it.
