Legal Question in Employment Law in Florida
My 18 year old daughter works at Applebees and makes 4.11 per hour + tipshare she was told today that if her tipshare is equil to or over minimum wage she dosen't get her pay only tipshare. Is that legal?

If her employment contract with Applebees is what you say it is, she should get her hourly rate and the tipshare. If her employer does not honor that contract (and she needs to have some proof of what the contract is), then she has a number of different remedies under both contract and fair wage and hour laws. I would contact an attorney in that speciaty, to see what can be done, if she is not properly paid, per her employment contract.
She should be getting min wage plus tips. If you need more information on this situation, feel free to check out our employee rights blog www.takethisjobnshoveitblog.com or call my office.
