Legal Question in Employment Law in Florida
Accrued Vacation Leave Pay
If you are terminated from your job, are you entitled to be paid for any unused vacation time? Also if you had a bonus due you, are you entitled to receive it as well.

Re: Accrued Vacation Leave Pay
There is no law in Florida that mandates that unused vacation be paid upon termination. It therefore depends on the policies and practices of the employer and the specific facts of each case if there is no contract. Your argument, though, is that you worked for it and earned it in return for your work. Thus you should receive it.
It is the same for bonuses. It depends on the policies and practices if there is no contract, but you can make the contractual argument that the bonus was bargained for and earned (if that is the case).
If there is a large amount of money at stake, it is worth making a written demand of the employer and then possibly suing. But you should review the facts of the case with an attorney, and also have an attorney should you decide to sue.
Feel free to call for a free consultation if you want to review the matter.
Good luck.
