Arbitration Winner
I am Union President where I work, the harassment had escalated to the point of termination. After 8.5 months I had a hearing in front of an Arbitrator and won my case with full back pay and benefits. However, since I have been back to work the Mgmt. team have stepped up the harassment to the point I am ready to quit or they will pull another bogus termination. Do I have any Federal or State rights, that are available and affordable to get the Company off my back and just let me do my job? I enjoy my job, but the stress is getting unbearable. I have Supervisors stating I am insubordinate, with no witnesses around, I have no way to protect myself from these false accusations. I am to the point of nervous, mental exhaustion.

I am sorry to hear this. You would need to have a full blown consultation with a lawyer to be clear. From what I can see with this bit of information, the "short" story is that you could hire a lawyer to send them a letter asking them to stop retaliating against you for excercising your rights. However, the "bottom line" is that you will probably need some form of tangible employment action, such as a demotion, reduction in pay or termination, to proceed with a case. So if you can read between the lines, you can see how, unfortunately, it could be possible to give you a hard time without really incurring in any liability. But, there are other non-legal avenues that you could pursue, such as the press. I suggest that you consult with an attorney, although most lawyers who specialize in this area like me will charge you for a consultation, since you may be better off in the long run.
